Legal Rights Information
Since 1982, the U.S. Supreme Court has guaranteed that all children have a right to free public education, regardless of immigration status (Plyler v. Doe). California Education Code also guarantees these rights for students. (EC § 200 et seq).
What has changed?
In September 2025, two new state laws (AB 49 and SB 98) went into effect. These laws were designed to restrict federal immigration enforcement actions at schools and daycare centers.
- AB 49 prohibits any law enforcement agent carrying out immigration actions from access to school campuses or student records without a signed judicial order.
- SB 98 requires mandatory notification by LEAs and charter schools whenever immigration officers are present on the school site.
